Meet Haley Delano Haley Delano, Operations Assistant – JMS Yachting USA We are pleased to introduce you to Haley Delano who has joined the JMS Yachting USA team. She will be taking care of the Operations supporting JMS USA President, Rick Thomas and USA Fleet Manager, Nicholas Gray in view of our growing USA fleet. Born in Miami, Florida, Haley spent 10 years in the property management field and has been boating her entire life. She grew up acting as first mate on the fishing boats her family used to charter travelling throughout South Florida and the Caribbean.Her mantra is to work hard to know what you don’t know, and always take the time to get in right in the beginning. A great fit and attitude to be part of the JMS USA team who just started in September 2022. In her free time, she enjoys free diving, fishing and all other ocean related activities. She is also another motorbike fan, having a Harley Davidson cruising around Fort Lauderdale. Has that become a requirement to be part of the JMS team ? Meet Nick Gray

Meet Nick Gray Nick Gray, President, JMS Yachting USA We are thrilled to introduce you to Nicholas Gray who has just joined JMS USA as Fleet Manager with 18 years’ experience in yachting including 2 years ashore. Born in Hamilton, New Zealand, Nick lived mostly in Tauranga, an amazing beach area. An incredibly active and passionate person who started sailing at 17 and completed all yacht courses to the Master 3000. He is also a certified Diving Instructor. Nick spent 1 year as a deckhand before being promoted to his first mates job on a 135ft @lurssen, MY Blind Date and, thereafter, worked mostly on 160/170 ft but up to 240ft yachts. Well travelled, Nick has cruised the Mediterranean, Caribbean, Bahamas, East Coast US, South Pacific, Central and South America; and now lives in Fort Lauderdale, Florida. During his spare time, Nick loves spending time with his children and loves to BBQ. He would love to travel to all the sports events around the world like the Olympics, Americas Cups and Superbowl. Please give a warm welcome to Nick who will be the core of our JMS USA technical management team with his broad experience and passion which makes all the difference! On behalf of the JMS team, a big thank you to Rob Pijper, Franc Jansen and Sam Thompson Cert RP for hosting a wonderful Christmas weekend together in Amsterdam. It was a 2 in 1 weekend, constructive and festive! Everyone thoroughly enjoyed spending time together in such a beautiful city. It is also very fulfilling to be part of a team in expansion where each person has contributed to the development of JMS Yachting which only started in 2015. Whilst here, the JMS team would like to wish a happy festive season to our friends, collaborators and colleagues. Inspection campaign on STCW

Inspection campaign on STCW Member Authorities of the Tokyo and the Paris Memoranda of Understanding (MoU) on Port State Control will launch a joint Concentrated Inspection Campaign (CIC) on STCW. The campaign on STCW aims to confirm that: the number of seafarers serving on board and their certificates are in conformity with the relevant provisions of STCW Convention and Code and the applicable safe manning requirements as determined by the Flag State Administration; all seafarers serving on board, who are required to be certificated in accordance with STCW Convention, hold an appropriate certificate or a valid dispensation, or provide documentary proof that an application for an endorsement has been submitted to the Flag State Administration; the seafarers on board hold a valid medical certificate as required by STCW Convention; the watch-keeping schedules and hours of rest indicate compliance with the requirements of STCW Convention and Code; The CIC will assist in raising the awareness of shipowners, operators and crew on the specific requirements in the STCW Convention and Code. This campaign will be held for three months, commencing from 1 September 2022 and ending 30 November 2022. The CIC inspections will be applicable for all ships and conducted in conjunction with the regular Port State Control inspection.A ship will be subject to only one inspection under this CIC during the period of the campaign. Port State Control Officers (PSCOs) will use a list of predefined questions during the CIC. If deficiencies are found, actions by the port State may vary from recording a deficiency and instructing the master to rectify it within a certain period of time to detaining the ship until the detainable deficiencies have been rectified. Meet James Kirby

Meet James Kirby James Kirby – JMS Yacht Management James is joining JMS Yacht Management as a Fleet Manager, based in Barcelona and PalmaBorn in Nottingham, England and raised in Cambridgeshire, it has been over 20 years since he has called the UK home which is now Barcelona. Coincidentally, this is where his favourite marina is located: Port Vell. After concluding studies in Media, he found himself working on other shores in the USA and Norway in educational roles, before taking the leap into the seagoing side of the yachting industry in the early 2000’s. A decision that carved out a happy pathway to captaincy having moved through all the ranks up to Chief Officer at the100m level; and Captain in the 60M range, his last command being on a 55M charter vessel. He attained an MCA master 3000GT licence amongst other relative qualifications, yet it was the working knowledge and experience gained over the last 10 years especially, on extremely busy dual season charter vessels, that helped him hone his skills to build sound practical knowledge of all things expected of a busy ISM/ISPS/MLC compliant vessel. James was lucky enough to be a captain in this dynamic, prestigious and exciting industry, which has helped in shaping him for the next challenge……..from ashore to yacht management. He is happy to be on shore and enjoying the role after one year in yacht management! Outside of work, James has switched his hobbies to spend more time with his children involving a lot of swimming, cycling and climbing centres. A very active person! Anchoring in the French waters Anchoring in the French waters | New Regulations Antibes, 20th June 2022 – Last Thursday, the Prefecture Maritime issued a new regulation regulating the mooring time for ships in French Med territorial waters The RegulationAccording to existing regulation (Art.3):– All yachts exceeding 80 meters are required to seek anchoring authorisation by calling the CROSS. These authorisations are provided for 24 hour periods, renewable. – All yachts exceeding 45 meters but less than 80 meters are required to declare anchoring intentions. Art. 4 introduces the new regulation:Art. 4.1 and 4.2 indicate that yachts smaller than 45 meters are not required to seek authorisations or declare anchoring intentions. They can anchor for up to 72 hours, renewable. They must maintain appropriate watch. What should be Art.4.3 (there are two Art. 4.2. – obviously a typo) introduces the real important matter: “The duration of the anchoring can be reduced by maritime authorities for reasons related to maritime safety, traffic or environmental protection”. 25% duty on USA built yachts

25% duty on USA built yachts As you may remember, there is a 25% duty ad velorem applicable to yachts built in the USA since 2018 It is expected that these duties will be removed form January 1st 2022. However, the board of ECPY would like to point out that one very important considerations for yachts imported in the EU prior the June 22nd, 2018; if they are still owned by the same owning company to this day, they will need to carry out at least one charter under commercial registration prior to the end of this year (2021). it is crucial condition to benefit from the commercial exemption next year (2022). On another note, yachts who were imported a little after June 22nd, 2018 (who slipped through the cracks) under the commercial exemption will no benefit from the French commercial exemption in 2022 if they are still under the same ownership as the would be liable for the additional duty which operative event too place upon the latter importation.
